Terms of Service

Welcome to Kundera. These Terms of Service ("Terms") govern your use of the mobile application, website, and related services (the "Service") provided by Bluestack ("we"). By using the Service, you agree to these Terms.

1. User account

To use the Service you must create an account by providing accurate information. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

You must be 18 years or older to use the Service.

2. Use of the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You agree not to:

• Use the Service for illegal purposes or in ways that infringe the rights of third parties.
• Access or attempt to access accounts or data that do not belong to you.
• Reverse engineer, disassemble, or modify the Service.
• Use unauthorized bots, scrapers, or automated tools.
• Overload the Service infrastructure.
• Generate content that violates local laws, copyright, image rights, or that is defamatory, fraudulent, discriminatory, or misleading.

3. User content

You retain ownership of the content you generate, input, or upload to the Service (instructions, context data, articles, etc.).

You grant us a limited license to process that content solely to provide you with the Service (storing it, displaying it, sending it to the AI models that generate the articles, syncing it with your CMS if you configure it).

The Service, including its software, design, brand, logos, and documentation, is owned by Bluestack and protected by intellectual property laws. We grant you no rights over these elements beyond the use license described above.

6. Subscription and payments

Some features of the Service may require a paid subscription. Specific terms (price, frequency, renewal) will be displayed before confirming the purchase. Subscriptions automatically renew unless cancelled before the end of the period.

7. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms, if your activity poses a risk to other users or the Service, or for legal reasons. We will notify you when reasonably possible.

You can delete your account at any time from the app (More → Delete account) or from this page.

8. Availability

We make reasonable efforts to keep the Service operational but do not guarantee uninterrupted availability. We may perform scheduled maintenance or apply changes to features.

9. Limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, Kundera will not be liable for indirect, incidental, special, or consequential damages arising from use of the Service, including loss of data, lost profits, or reputational harm.

Our aggregate liability for any claim related to the Service is limited to the amounts paid by you in the last 12 months, or USD 50, whichever is greater.

10. Indemnification

You agree to indemnify Kundera and Bluestack against claims arising from your improper use of the Service or from content you publish on third-party platforms using drafts generated through the Service.

11. Changes to the Terms

We may modify these Terms when necessary. Material changes will be notified within the app or by email at least 15 days in advance. Continued use of the Service after the effective date implies acceptance.

12. Governing law and jurisdiction

These Terms are governed by the laws of the Argentine Republic. Any dispute will be resolved before the ordinary courts of the Autonomous City of Buenos Aires.
